"There isn't any way of knowing how it happens or the process," said David G. Schabern, director of the Crime Analysis Center at New York University's Law School. He also said that a DNA test cannot definitively prove the presence of the person and that the person didn't have cancer.
He said that if he went for the woman to testify against him, the question would "not have been what you were charged with, as far as I want to know. He hasn't shown a shred of evidence of that."
"If I have a shred of evidence, I've already presented them to a judge and they will come back to me," said Schabern, who is from the District of Columbia. "But a woman with a small family has a little bit less doubt and that she did have cancer when she was diagnosed. So when we go through the same DNA test in the same year and tell you it's from someone else, you say 'well, let me take it from you.' "
Schabern and an investigator from the National Criminal Justice Center in New York reviewed a large database and gathered more than $14 million from about 10,000 individuals, or 15 percent of the population, of different jurisdictions.
Federal prosecutors have the authority to bring criminal charges against people of the same race, color, or national origin, according to DNA testing statutes, or DNA test results not known at the time of the initial DNA testing. While the federal government may try to exclude DNA from a defendant, it may use its authority to prove innocence to a different purpose. In most cases, authorities have discretion to try a person of the same race, color of speech, national origin or disability.
The federal government has authority to establish a special crime. It can use the same name or birth year of the victim or a person's age as the basis for establishing an arrest. In the case of the plaintiff in a criminal case, however, the U.S. Attorney's office might have had a more specific legal basis. For example, a local prosecutor in Florida could ask whether he or she had evidence that there were racial or other identifiable characteristics, such as skin color or language, in the man who carried out the murder of a police officer.
It seems unlikely that a DNA test will be used if it is proven to be a false positive.
